부담금은 법령에 의한 기속행위고
과징금은 행정청의 재량행위다!!!

따라서 과징금은 법원이 위적법 여부만 심사할 수 있고 행정청의 재량을 월권하여 그 액수를 변경하거나 일부취소할 수 없다!

기속행위인 부담금의 경우에도 적법절차에 의해 정당한 부과금액을 산출할 수 없으면 일부취소할 수 없다!
