아니 그리고 마치 파기환송으로 2심에 돌아갔던 판결이 파기환송 취지에 안 맞는다면서 또다시 2심으로 내려보내는 그런 일은 이전에도 종종 있지 않았습니까? 대법원은 가능하고 헌재는 불가능함?
