윤석열 대통령 파면 결정에 보수 성향으로 분류되는 헌법재판관 3명 모두 탄핵 인용에 사인하면서, 이른바 ‘재판관 5대3 데드록(교착 상태)’은 실체가 없거나 극우·보수 진영의 바람에 불과한 것으로 드러났다. 특히 재판관 개별 판단을 엿볼 수 있는 ‘보충의견’에서도 윤 대통령 파면을 부른 비상계엄 선포의 위헌·위법 판단에 대한 이견은 단 한 줄도 드러나지 않았다.
