【力神-男士保健品專家特約】中國媒體報道，河南鄭州早前出現一宗罕見個案，一名23歲男子因無法小便及劇烈下腹痛，到急症室求診。事主到達急症室時面色蒼白、滿頭冷汗，身體佝僂並緊按下腹，神情扭曲。醫護人員隨即安排超聲波檢查，結果發現其膀胱內有條狀異物正在蠕動，周邊伴隨出血跡象。
泌尿外科醫生其後透過內窺鏡進一步檢查，確認膀胱內有一條長約5至6厘米的水蛭，正吸附於膀胱黏膜上，導致局部嚴重充血及水腫，為事主帶來劇痛及排尿困難。醫生隨即經尿道將該條已吸飽血液、體態腫脹的水蛭取出，手術完成後，事主疼痛明顯緩解。
經了解，事主早前在網上接觸到一些所謂「偏方」，聲稱將水蛭置入人體可帶來「特殊效果」。出於好奇及獵奇心理，他從網上購買活水蛭，並自行將其塞入尿道，水蛭隨後沿尿道進入膀胱寄生，最終引發嚴重不適送院。

- 행정소송법은 집행정지라는 가구제제도를 두고 있어 민사소송법상의 가처분을 준용하지 않는다.
그러나 집행정지는 '처분' 만을 대상으로 할 수 있으므로, 행정상 항고소송에만 적용될 수 있으며 부작위위법확인소송과 당사자소송에는 적용되지 않는다.
이 경우에는 행정소송법상의 가구제가 불가능하여, 민사소송법상의 가처분제도를 준용할 수 밖에 없다.
'... 관리처분계획안에 대한 조합총회결의의 효력을 다투는 소송은 ... 이러한 당사자소송에 대하여는 행정소송법 제23조 제2항의 집행정지에 관한 규정이 준용되지 아니하므로, 이를 본안으로 하는 가처분에 대하여는 행정소송법 제8조 제2항에 따라 민사집행법상 가처분에 관한 규정이 준용되어야 한다(대결 2015. 8. 21, 2015무26).'
참고로 이 케이스에서 도시 및 주거환경정비법(이하 도시정비법)상 관리처분계획안은 아직 처분성을 지닌 관리처분계획이 아니라 계획'안'에 불과하지만, 처분으로 가는 과정으로 판단하여 공법관계가 인정된다.
