- 그런데, 행정소송법 제8조에 의해 행정소송에도 민사소송법의 규정이 준용되므로, 민사소송법상의 소변경(청구취지의 변경 등)이 허용된다. 이 경우에는 민사송법상의 소변경에 관한 원칙이 적용되므로, 제소기간의 준수 여부는 원칙적으로 소의 변경이 있은 때를 기준으로 한다.
